Terms & Conditions

1. Scope

These General Terms and Conditions (hereinafter "GTC") apply to all contracts concluded via the Everyacht platform between us (the platform provider) and users (customers and yacht owners).

2. Subject of Contract

Everyacht provides an online platform through which charterers can offer yachts and customers can rent them. Unless otherwise indicated, Everyacht acts as an intermediary. The charter contracts are concluded directly between the yacht owner and the customer.

3. Booking and Contract Conclusion

By booking via the platform, the customer submits a binding offer to conclude a charter contract. The contract is concluded when the charterer (or Everyacht acting on their behalf) confirms the booking.

4. Payment Terms

Unless otherwise agreed, a deposit of 50% of the charter price is due upon booking. The balance is typically due 4 weeks before the charter begins. For short-notice bookings, the full amount is due immediately.

5. Cancellation by Customer

If the customer withdraws from the contract, the cancellation conditions of the respective yacht owner, which are displayed during the booking process, apply. We strongly recommend taking out travel cancellation insurance.

6. Liability

Everyacht is liable for intent and gross negligence. For slight negligence, we are only liable in case of breach of essential contractual obligations. Liability for damages resulting from injury to life, body or health remains unaffected.

7. Final Provisions

The law of the Federal Republic of Germany applies. The place of jurisdiction is, insofar as legally permissible, the registered office of our company. Should individual provisions of these GTC be invalid, the contract remains valid in all other respects.
